Terms of Use

These Terms of Use (“Terms”) apply to your use of the Aeon School website, mobile apps and dashboards (the “Service”), provided by Aeonian Technology Inc. (“Aeonian”, “Aeon”, “we”, “us”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If your school or bus operator has a separate subscription agreement with us, that agreement governs their use of the Service, and it takes priority over these Terms if the two conflict.

1. What Aeon School is, and what it is not

Aeon School is a technology service that shows bus locations, records when students board and leave the bus, and sends notifications. Transportation itself is provided by your school or bus operator, not by Aeonian. Your school or bus operator is responsible for routes, drivers, schedules, student supervision and safety, and for telling families about changes such as a new driver or a cancelled route.

Aeonian does not hire, employ, screen, verify or approve drivers. Decisions about who drives for a school or bus operator, including identity, background, license and insurance checks, belong to that school or operator. Where Aeon School offers driver verification tools, they help the operator carry out its own checks. They do not transfer that responsibility to Aeonian.

Aeon School is not an emergency service. Location and arrival times depend on GPS, mobile networks and the driver’s device, and may sometimes be delayed, inaccurate or unavailable. Notifications may arrive late or not at all. Do not rely on Aeon School alone for your child’s safety. In an emergency, call 911 or your local emergency number, then contact your school or bus operator.

2. Who can use the Service

You must be at least 18 years old, or the age of majority where you live, to create an account. Parent and guardian accounts are created through your child’s school or bus operator. Driver and staff accounts are created by the bus operator or school you work with. Students do not have accounts.

3. Your account

• Keep your login details private, and do not share your account with anyone.
• Make sure the information in your account is accurate and up to date.
• Tell us right away at sayhello@aeon-app.com if you think someone has accessed your account without permission.
• You are responsible for activity on your account.

4. Responsibilities of schools and bus operators

Schools and bus operators that use Aeon School agree to:

• Hire, screen and supervise their drivers, and verify each driver’s identity, driver’s license, insurance and any other licenses or checks required by law or their own policies, before approving the driver.
• Make sure the person who approves a driver is not the same person who created the driver’s account and sent their login details.
• Enter accurate student, route and stop information, and keep it current.
• Make sure they have the right to share student and family information with us.
• Activate each driver’s account before the driver’s first trip, and keep trip assignments up to date.
• Tell families promptly about changes that affect them, such as a replacement driver, a route change or a cancelled trip.
• Follow the subscription agreement and all laws that apply to student transportation and privacy.

5. Optional driver verification tools

Aeon School lets schools and bus operators verify drivers in two ways: by reviewing documents manually in their dashboard, or by connecting an automated verification service from a third-party provider, which checks identity documents and, where available, license status. Automated verification is optional, and the operator chooses the provider and pays for it. Proof of insurance is currently reviewed manually by the operator’s own staff.

Verification results come from third-party providers and government records, which can be incomplete or out of date, and we do not guarantee them. The final decision to approve, reject or remove a driver always rests with the school or bus operator.

6. Rules for drivers

Drivers must follow all traffic and distracted-driving laws. Only use the driver app when the bus is safely stopped, such as when checking students on or off at a stop. Never use the app while the bus is moving. Keep location services and notifications turned on during trips so families receive accurate information.

7. Acceptable use

You agree not to:

• Use the Service to track, contact or monitor anyone other than as intended, or to access information about a student who is not yours to see.
• Share screenshots or data showing other children’s information or bus locations.
• Interfere with or disrupt the Service, try to gain unauthorized access, or test its security without our written permission.
• Copy, reverse engineer or resell the Service, or use automated tools to collect data from it.
• Use the Service for anything unlawful, harmful or misleading.

8. Fees

Some features may require payment. Fees, billing and refunds are described at the time of purchase or in your organization’s subscription agreement. Payments are processed by our third-party payment processor.

9. Privacy

Our Privacy Policy explains how we collect, use and protect personal information. By using the Service, you acknowledge that your information will be handled as described there.

10. Our intellectual property

The Service and its content belong to Aeonian or our licensors. We give you a limited, personal, non-transferable right to use the Service as intended under these Terms. Our Copyright Policy explains how you may use our content and how to report infringement.

11. Feedback

If you send us suggestions or ideas, we may use them to improve Aeon School without owing you anything. We will only publish your comments with your name, or attribute them to you, if you have given us permission.

12. Third-party services

The Service relies on third-party services such as app stores, mapping, messaging and payment providers. Their own terms may apply, and we are not responsible for their services.

13. Changes and availability

We may update, change or discontinue features of the Service. We aim to keep the Service available, but we do not guarantee it will always be uninterrupted or error-free, including during maintenance.

14. Suspension and termination

You can stop using the Service at any time. We, or your school or bus operator, may suspend or close your account if you break these Terms, if your organization’s subscription ends, or if needed to protect the Service or its users.

15. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, including that bus locations, arrival times or notifications will be accurate, complete or timely, or that any driver verification result is accurate or complete.

16. Limitation of liability

To the extent permitted by law, Aeonian is not liable for indirect, incidental, special or consequential damages, for damages caused by the acts or omissions of schools, bus operators, drivers or other third parties, or for any decision a school or bus operator makes about hiring, approving or removing a driver. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

17. Indemnity

To the extent permitted by law, you agree to cover our reasonable losses and costs arising from your misuse of the Service or your breach of these Terms.

18. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ontario, except where the law of the place you live gives you the right to bring a claim there. Nothing in these Terms limits consumer rights that cannot be waived under the law where you live.

19. Changes to these Terms

We may update these Terms. If a change is significant, we will tell you through the app or by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
